1 About these Terms عن هذه الشروط

These Terms & Conditions ("Terms") govern your use of mssbars.com (the "Website") and any orders placed with MSS Gold Bahrain ("MSS Gold", "we", "us", "our"), a Bahraini registered company (CR #130443-1) with offices at Building 208, Block 304, Road 362, Gold Souq, Bab Al Bahrain, Manama, Bahrain.

By using the Website, browsing prices, or placing an order, you agree to be bound by these Terms together with our Privacy Policy. If you do not agree, please do not use the Website.

2 Eligibility الأهلية

Customers using the Website who are minors / under the age of 18 shall not register as a User of the Website and shall not transact on or use the Website.

By using the Website you represent that you are at least 18 years of age and capable of entering into a binding contract under the laws of the Kingdom of Bahrain.

3 Use of the Website استخدام الموقع

The User is responsible for maintaining the confidentiality of his account, contact details, and any communication used to place or confirm orders.

All content on the Website — including text, images, product photographs, the MSS Gold name and logo — is the property of MSS Gold or its licensors. You may not reproduce, redistribute, or commercially use this content without prior written consent.

You agree not to use the Website to violate any law, infringe rights of any party, interfere with the operation of the Website, or attempt unauthorised access to any part of it. We reserve the right to refuse service or terminate access at our sole discretion.

4 Live pricing & gold-rate fluctuation الأسعار الحية وتقلب سعر الذهب

Gold and silver prices shown on the Website are based on live international spot prices and change every second. Any price displayed, quoted, or saved is indicative only and is binding only after MSS Gold has expressly confirmed your order at that price (whether by WhatsApp, phone, email, or in-person).

Prices are quoted in Bahraini Dinar (BHD) unless explicitly stated otherwise. We make reasonable efforts to display accurate prices but do not warrant that any displayed price is free from error. In the event of a clear pricing error, we may correct the price or decline the order without further obligation.

5 Orders & confirmation الطلبات والتأكيد

Any enquiry placed through the Website, WhatsApp, phone, or in-person constitutes an offer to purchase. A binding contract is formed only when MSS Gold expressly confirms acceptance of your order.

We reserve the right, in our sole discretion and without explanation, to refuse, modify, or cancel any order — including (without limitation) cases of suspected fraud, payment failure, stock unavailability, identification concerns, or rapid market movement between the price quote and order acceptance.

6 Payments & transaction records الدفع وسجلات المعاملات

We accept payments online using Visa, Mastercard, American Express, and BenefitPay in Bahraini Dinar (BHD). Cash and BenefitPay on delivery are accepted within the Kingdom of Bahrain.

Payments are processed by our payment provider (Amazon Payment Services) via a secured connection. MSS Gold does not store, share, sell, rent or lease any card details — see our Privacy Policy for full details.

The cardholder must retain a copy of transaction records and Merchant policies and rules.

7 Delivery, returns & refunds التسليم والإرجاع والاسترداد

Delivery terms are set out in our Delivery & Shipping Policy. Returns, refunds, cancellation and replacement terms are set out in our Refund & Cancellation Policy. Both policies form an integral part of these Terms.

8 Disclaimers & limitation of liability إخلاء المسؤولية وحدودها

No warranties. The Website and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by Bahraini law, MSS Gold disclaims all warranties, express or implied, including (without limitation) implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability. To the fullest extent permitted by law, MSS Gold's total liability arising out of or in connection with any order or your use of the Website is limited to the amount actually paid by you for the specific order to which the claim relates. We shall not be liable for any indirect, consequential, incidental, special, exemplary, or punitive damages — including (without limitation) loss of profits, loss of opportunity, or any loss arising from movements in the market price of gold or silver — even if advised of the possibility of such damages.

Force majeure. MSS Gold is not liable for any failure or delay in performing any obligation under these Terms caused by events beyond our reasonable control, including (without limitation) acts of God, war, civil disturbance, government action, market or banking closures, supply-chain disruptions, telecommunications failures, or pandemics.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded under the laws of the Kingdom of Bahrain.

9 Termination & right to refuse service الإنهاء وحق رفض الخدمة

We reserve the right, in our sole discretion and without notice, to suspend or terminate access to the Website, refuse service, or cancel any order at any time, without prior obligation to explain.

10 Governing law & jurisdiction القانون والاختصاص القضائي

The Kingdom of Bahrain is our country of domicile and the local Bahraini law is the governing law of these Terms.

Any dispute or claim arising out of or in connection with this Website or these Terms shall be governed by and construed in accordance with the laws of the Kingdom of Bahrain. The courts of the Kingdom of Bahrain shall have exclusive jurisdiction over any such dispute.

11 Changes to these Terms التغييرات على الشروط

The Website Policies and Terms & Conditions may be changed or updated occasionally to meet the requirements and standards. Therefore the Customers are encouraged to frequently visit these sections in order to be updated about the changes on the website. Modifications will be effective on the day they are posted.
